These Terms and Conditions ("Terms") govern your access to and use of the services provided by ZEROxZERO ("we," "our," or "us"), including our website, staffing and recruiting services, and SMS/text messaging communications program (the "Program").

By accessing our website, engaging our services, or providing consent to receive text messages from us, you agree to be bound by these Terms. If you do not agree, please do not use our services or opt in to our SMS Program.

ZEROxZERO is an engineering talent agency providing staffing, recruiting, and IT consulting services. As part of these services, we communicate with candidates, clients, and partners via phone, email, and SMS/text messaging to facilitate job matching, interview scheduling, and service updates.

3. SMS/Text Messaging Program Terms

3.1 How Consent Is Collected (Physical/Written Consent)

Unlike a website opt-in checkbox, ZEROxZERO collects consent to send SMS messages through a physical, offline process. This may include, but is not limited to:

• A signed paper application, intake form, or candidate registration document completed in person or by mail
• A printed sign-up sheet collected at a career fair, hiring event, or in-office meeting
• A signed service agreement or engagement contract with a client or candidate that includes an SMS consent clause
• A business card or written note voluntarily provided to our recruiting staff with an accompanying verbal or written request to be contacted by text

By signing or submitting any of the above physical documents and providing your mobile phone number, you expressly consent to receive text messages from ZEROxZERO related to the categories described in Section 3.2. This written consent is retained in our records as proof of opt-in for compliance purposes.

Consent to receive SMS messages is not a condition of using our services. You may still engage ZEROxZERO's staffing and recruiting services without opting in to text communications.

3.2 Types of Messages Sent

Once you have provided consent, you may receive the following types of messages:

• Job opportunity notifications
• Interview reminders and scheduling updates
• Application and placement status updates
• Service updates and account-related announcements
• Marketing messages (only if you have separately and explicitly agreed to receive them)

3.3 Message Frequency

Message frequency varies depending on your engagement with our services:

• Transactional messages: Sent as needed to support active job placements, interviews, or service delivery
• Marketing messages: Up to 4 messages per month, only if you have opted in to marketing communications

3.4 Message and Data Rates

Message and data rates may apply depending on your mobile carrier plan. ZEROxZERO does not charge for sending or receiving text messages, but your wireless carrier may charge standard messaging rates.

3.5 Opt-Out Instructions

You may opt out of SMS communications from ZEROxZERO at any time by:

• Replying STOP to any text message you receive from us
• Texting STOP to (469) 210-5888

• Notifying your ZEROxZERO recruiter or point of contact in writing

After you opt out, you will receive one final confirmation message. No further messages will be sent unless you opt back in by providing new written or verbal consent through our physical intake process.

3.7 Supported Carriers

Our SMS Program is supported on all major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, and others. Carriers are not liable for delayed or undelivered messages. Not all carriers are guaranteed to be supported; check with your carrier for details.

3.8 No Warranty on Delivery

ZEROxZERO does not guarantee the delivery, timeliness, or security of SMS messages, as these depend on factors outside our control, including your carrier's network and device settings.

4. Use of Our Website and Services

4.1 Eligibility

Our services are intended for individuals who are at least 18 years of age. By using our services, you represent that you meet this requirement.

4.2 Acceptable Use

You agree not to use our website or services for any unlawful purpose, to misrepresent your identity or qualifications, or to interfere with the proper functioning of our systems.

4.3 Accuracy of Information

You are responsible for providing accurate and current information, including your contact details, professional experience, and phone number used for SMS consent.

5. Intellectual Property

All content on our website, including text, graphics, logos, and software, is the property of ZEROxZERO or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

6. Disclaimers and Limitation of Liability

Our services, website, and SMS Program are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied. ZEROxZERO does not guarantee job placement, interview outcomes, or specific results from use of our services.

To the fullest extent permitted by law, ZEROxZERO shall not be liable for any indirect, incidental, or consequential damages arising from your use of our website, services, or SMS Program.

7. Indemnification

You agree to indemnify and hold harmless ZEROxZERO, its officers, employees, and agents from any claims, damages, or expenses arising from your violation of these Terms or misuse of our services.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Montana, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Flathead County, Montana.
